Latest has it that the defender has lawyered up. If so good on him but he’ll need some luck if it gets to a grand jury in H-town.
My total-layman, non-lawyer opinion of the shoot: All the shots until the bad guy fell down were probably justified. The two or three more while his “gun” was still accessible are problematic, but probably justifiable as well.
But that last one, taken after the bad guy was down and his “gun” kicked away, could come back to bite him, Michael-Dunn-style. At that point, the threat was neutralized and the danger passed.
Only time will tell if charges get filed, but if I were him I’d be contacting a lawyer and keeping a low profile.
If justified, I would keep shooting until the armed perp stopped moving. Almost dead men can still raise their hand and shoot. The three kill shots can easily be written off as , “he kept moving the hand that had the gun”.
Someone holds a gun on you, how long do you have to determine if it is real or not?
Maybe he should talk, but only after FULL IMMUNITY is granted in writing.
