There will be plenty of time to make your case later, providing there is a later. Making a losing argument at the scene against overwhelming odds will never have a happy ending.
I’ve seen all the fringe flag/ admiralty court/ sovereign citizen/ corporate ALL CAPS arguments before and have not only never seen them prevail, but have never seen a clearly defined strategy for getting enough people to buy into them to where they have a chance of prevailing.
I had one of those types trolling me years ago, airing his self-presumed superiority over me because he claimed he knew how to exercise RKBA regardless of the laws. Thing is, he would never share how and especially would never demonstrate.
Believe otherwise and argue if you like. I’m not the guy who’s going to shoot you. Argue it with enforcers and do like Chase here, and it kind of all becomes a moot point outside of another Darwin Award that the world will soon forget.
Or change my mind. Walk through “sensitive zone” Times Square with an unregistered machine gun and prove to us all how your “legal” arguments win the day. A nation of gun owners will be grateful and your name will belong to the ages!
As someone else put it, confused cops arrest; scared cops shoot.
Swallow your pride and do your level best to not present a threat. If they don’t know the law, the site of the stop isn’t the time or place to educate them. And it’s certainly not the time to be fondling, reaching for, or gesturing toward your gun.
That’ll scare them, and scared cops shoot.
So be as non-threatening as possible. Maybe a sergeant will show up who knows better, or maybe they’ll all just be confused enough to arrest. You’ll have a chance to clear it up later, when you don’t have guns pointed your direction.
