I’m surprised there’s not a non-compete provision that will tie this up in court.

Not necessarily. Many companies (in states that allow it) require them as job acceptance conditions, and they are also used in business partnership agreements.
True; but the founder of a company rarely has to fill out an employment agreement, and he didn’t have any partners. Whether his new board thought to ask, or O’Keefe thought to refuse, are questions that I suspect the new venture answers.
Right. And I find that surprising.
