SCOTUS tinkered with the process a bit, the “final rule” goes back into effect while the lower court(s) decide on the merits of the case. I think the lower court already hinted that they think the rule needs to be thrown out for a number of reasons.
1. Congress could have worded GCA68 to include partially completed “firearms” bu chose not to.
2. In a recent case SCOTUS ruled that a federal agency cannot extend existing law through the rule making process.
