IANAL, so I have to ask: What would it take to make an “equal protection” claim on that? No defendant should be getting a break because he/she is politically-connected, so if someone does, wouldn’t anyone accused of the same crime under similar circumstances be entitled to the same break?
If he claims that he identifies as Biden, he may get released.
