But in Texas too many ‘defense’ incidents go to a grand jury rather than simply be recorded as, well, as defense of self, home, etc.
My understanding is that in Texas all homicide cases go to a grand jury for return of either a true or no bill of indictment. I suspect that in clear self defense cases the state attorneys present the evidence and request that the grand jury return “no bill.” Presumably this establishes a more concrete (and recorded) legal/procedural determination of justification than if prosecutors simply decline to pursue a case.
