We’re the Only Ones Tasteful Enough

A Homeland Security agent and his friend were accidentally shot at a wine tasting in Florida when his gun fell to the ground, according to police. [More]

I need to up my training. Not being a professional, my wife and I have been going to a wine-tasting fundraiser for a group we support for many years now, and I haven’t even come close to shooting myself, let alone her along with me.

One question though: Is that what I think it is?

Anybody know if off-duty “Only Ones” are exempt?

  1. So, the gun was unholstered, meaning it was in a pocket, or removed from its holster?

If it was indeed dropped, there should be some interesting angles in the wounds the bullet created.

  2. I am not a lawyer, so please do not take this as legal advice.

A “no firearms allowed” posted in a place not prohibited to the carrying of firearms by Florida Statute 790.06 License to carry concealed weapon or firearm, indicates that if the management of the place determines that you are carrying a firearm then they may demand that you leave or be trespassed out by local law enforcement if you do not leave voluntarily.

“If you are not engaged in fishing/camping/lawful hunting and do not have a concealed weapons license for your firearm, please secure your firearm within your vehicle while in a state park. Savannas Preserve State Park is the only park exception to the rules described above. Chapter 258.157, F.S., states that “it is unlawful for any person, except a law enforcement or conservation officer, to have in his or her possession any firearm while within the Savannas.”

You may carry your weapon within a Florida state park (except for Savannas Preserve State Park) as described above, but you may not fire that weapon within a state park.”

I do not see any language describing armed Federal agents in Florida Statute 790.

    1. But don’t forget the affinity of lawmakers to write laws starting with “Notwithstanding any other provision of law,” which can appear anywhere in the corpus and modify anything anywhere else. That’s why lawyers get the big bucks.
