  1. It wouldn’t be needed if the Supreme Court had interpreted the constitution correctly in Chae Chan Ping v. US (1889) and Fong Yue Ting v. US (1893). Instead, state sovereignty went out the window in favor of the traditional sovereignty of a national (not federal) government, and thus a “power implied in sovereignty” overrode the clear language of the constitution.
