I suspect this is more procedural than an indication that the Tenth Amendment can be disregarded at will by using a “Supremacy Clause” excuse.

I tend to agree with you on that one David. This court seems to be a “get your homework done before you bring it to us” bunch.
Its not on balance an activist court. They’re going to want a “hair on fire” crisis before they snatch anything out of the queue and tinker with it before the lower courts have had their say. They’re even more prone to handing cases back down the line with a red pencil “fix this” note to the court they think screwed it up rather than just issuing a reversal.
