“From that guidance, it does not appear that individuals can ‘keep’ both the brace and the ‘business end of the gun’ as you claimed in your sworn testimony,” the lawmakers added. [More]
Incompetence? Lying under oath? A little of both…?

Notes from the Resistance
Biggs said one of the Fast and Furious guns has recently been used in a crime. Biggs didn’t provide details of this crime, but said the ATF is now questioning the firearms dealer from which the gun emanated. [More]
I wish he would provide details because I’ve been asked and it caught me flat-footed, although I’ve been away from that story, and my original sources have moved on or gone silent.
I will take exception to one characterization Biggs made:
“Botched.”
If you believe that, you’ve allowed yourself to be misdirected from the get-go.
Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) Director Steve Dettelbach was unable to define the term “assault weapon” during his agency’s Tuesday budget request hearing before a House Appropriations subcommittee. [More]
To channel Nancy, they have to pass the rule before they can tell you what it bans…?
And people can go to prison or be killed over it? How is this not the definition of tyranny?

Dettelbach on the work of the ATF [Watch]
Now there’s the kind of hard-hitting watchdog journalism on guns we’ve come to expect from The Washington Post!
It’s almost like they’re a volunteer public relations department…
[Via Jess]
I’d argue my headline is more accurate. [More]
In April 2022, the Department of Justice announced the “Frame or Receiver” final rule that modernizes the definition of a firearm.
Read “illegally changes.”
Some suppliers of partially complete frames or receivers appear to be attempting to willfully circumvent the rule…
We’re coming for you. And your customers. Prepare for the J6 and/or Waco treatment.
It may also include internet links to templates, jigs, molds, equipment, tools or other materials that enable ready completion or assembly of the unfinished frame or receiver into a firearm.
Why would we worry about the First Amendment now that we’ve neutralized the Second?
Anyone who observes suspected violations of the GCA or ATF’s implementing regulations may report them to ATF at https://www.atf.gov/atf-tips.
“¡En cada barrio, Revolución!“
I must remember to thank Rob Portman for his Dettelbach confirmation vote!

Reps. Jordan, Massie demand ATF director testify before House Judiciary Committee [More]
Sure, it’ll be nice to point out all his inconsistencies in the echo chamber on a relatively obscure issue most Americans don’t care about, but if Republicans couldn’t do anything about it when they had the majority and Eric Holder told them to go F*** themselves, what makes them think they will be able to do anything about it with the Dems in the majority?
ATF Director Steve Dettelbach talks about enforcing gun laws amid surge in mass shootings [More]
Funny. That’s the same thing so many of our “gun rights leaders” say we need to do.
And note this admission:
But at ATF, our job is to take the rules and laws that Congress has passed…
Yeah, about that…
And while we’re on the subject, perhaps someone will be good enough to point out where Congress is delegated with the authority to infringe…?
[Via Jess]
Jordan says the ghost gun rule “goes well beyond the authority granted to the agency in any applicable federal statutes,” and expands the legal definition of a firearm beyond what Congress intended. A prior letter from Jordan to ATF declared the rule “appears to be a deliberate attempt to usurp the authority of Congress,” and said it unconstitutionally infringes “on American citizens’ fundamental Second Amendment rights and privacy rights under the Fourth Amendment.” [More]
He’s right about the agency lacking authority. What I’ve yet to see is where Congress can legitimately claim it.
And I don’t see too many on “our side” talking about that.

PLEASE TAKE NOTICE that Defendants Merrick Garland, in his official capacity as Attorney General of the United States; Steven Dettelbach, in his official capacity as Director of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF); the United States Department of Justice; and ATF hereby appeal to the United States Court of Appeals for the Fifth Circuit from the Court’s Opinion & Order on Scope of Preliminary Injunction entered on October 1, 2022… [More]
Of course they’re not giving up on unconstitutionally claiming authority to impose frame or receiver infringements. They enjoy unlimited resources.
FPC has the entire case with filings and orders indexed for us.

Steven Dettelbach, the newly sworn-in director of the Bureau of Alcohol, Tobacco, Firearms and Explosives, said there is no overarching answer to solving the nation’s gun violence, even as guns have become the leading cause of death for children in the U.S. [More]
All by their own selves?
This is how it works: Step one, acquire statistics on firearm-related deaths among children ages 1-14. Step two, combine that relatively low number with the far greater number of firearm-related deaths involving juveniles and young adults ages 15-19, or even ages 15-24. Step three, present the resulting data as the shocking number of “children” (ages 1-19 or 1-24) who are subjected to “gun violence” each day/week/month/year. Step four, use the disingenuous statistic to advocate for pre-determined gun control policies.
Gee, it’s almost like the media are the enemy or something…

A Cincinnati man filed an elections complaint Friday against Democrat Steve Dettelbach, saying the candidate broke state law by raffling off a chance to meet former U.S. Attorney General Eric Holder. [More]
That’s one thing ATF needs: Continuity!
2018, eh? Anybody remember this coming up in the hearings and getting media notice?
Why not?

Invoked, 48-46: Motion to invoke cloture on Executive Calendar #1037 Steven M. Dettelbach to be Director, Bureau of Alcohol, Tobacco, Firearms, and Explosives.
— Senate Cloakroom (@SenateCloakroom) July 12, 2022
I understand the vote will be this afternoon and will update this accordingly.
UPDATE

[T]he Senate Judiciary Committee considered the nomination of Steve Dettelbach to run the ATF during a hearing on Wednesday. [More]
With everything going on, this one isn’t getting the scrutiny it needs, meaning Republicans aren’t getting the scrutiny they need.
It’s not surprising that he can’t define “assault weapon,” but let’s not forget all the other questions.
[Via Jess]
Will they treat the Dettelbach nomination like the existential threat that it is, or will they play politics as usual and make just enough comments to claim plausible deniability on opposing him, without really doing anything concrete to upset a foregone conclusion? [More]
Will even one doer declare “You shall not pass!” and separate himself from the talkers? If he does, who will join him?
