All due respect to Mark Smith, but … yawn.
Regulations are not law. Repealing regulations can happen by Executive Order. Repealing law takes an Act of Congress.
Repealing the regulations that direct BATFE to enforce the law, does not repeal the law. The statutory law will still be there, and when the next President is sworn in he can re-direct BATFE to enforce it to the maximum scope and extent the language allows.
Sure, having a President willing to give this direction/order to repeal the bad regulations is great. But it’s temporary at best; the next President can re-do them on Day 1.
We saw Biden undo everything Trump v.1 ordered in his first week. We saw Trump v.2 undo most of what Biden ordered in his first week. Clearly, EOs and regulations are not permanent.
