The Truth Behind the Garland v. VanDerStok “Ghost Gun” Case

This is not the first time Justice Barrett has departed from conservative views on the Second Amendment, values she represented herself as a staunch supporter of when she was nominated to the Supreme Court by then President Donald Trump. [More]

Except she didn’t, the gun groups did.

As with all SCOTUS confirmation hearings, they don’t ask the tough questions needed to elicit unequivocal answers.

As noted when cautioning against rubber stamping Gorsuch:

Typically in judicial confirmation hearings, nominees have been able to rely on an “out” giving them a pass on answering specific questions… Think of one job you’ve ever applied for where you’d have gotten it if you decided to play coy with the hiring managers. While it may be “inappropriate” for a judge to weigh in on a specific case before confirmation — for legitimate reasons, including not having studied and evaluated all the particulars, evidence and precedents against the “supreme Law of the Land,” — there’s no reason why general principles of understanding should be off-limits. Such hearings are supposed to be, among other things, high-level employment interviews, not pre-coronation ceremonies.

Gun owners may be paying the price for that… again.

Looking a Gift Horse in the Mouth

The justices in a 6-3 vote on nonideological lines handed a win to defendant Joseph Fischer, who is among hundreds of Jan. 6 defendants — including former President Donald Trump — who have been charged with obstructing an official proceeding over the effort to prevent Congress’ certification of President Joe Biden’s election victory. That’s great news. But once again, Amy Coney Barrett casts doubt on her appointment.

She gave us Bruen, but as the saying goes, “What has she done for us lately?”

As I noted at the time:

While Barrett’s confirmation should give gun owners a degree of hope and should certainly be viewed as more positive than a Biden nominee being placed on the High Court, we’ll need to wait and see if the gun groups or the gun-grabbers are right in their assessments. Republican appointments have disappointed in the past. Warren Burger and David Souter coming to mind.

Back to J6, that means hundreds have been falsely accused, arrested, prosecuted, and imprisoned. Who will pay?

Democrats are still out there smearing them as insurrectionists and traitors.

Amy, What You Want to Do?

“Relying exclusively on history and tradition may seem like a way of avoiding judge-made tests,” she wrote in a concurring opinion. “But a rule rendering tradition dispositive is itself a judge-made test. And I do not see a good reason to resolve this case using that approach rather than by adopting a generally applicable principle.” [More]

Between this, Gorsuch playing for the other team, Machine Gun Sammy giving “how to ban” instructions, Kavanaugh looking the Bruen gift horse in the mouth, and Roberts being Roberts, you’ll have to forgive me if I don’t view the bump stock opinion as proof our troubles are over.

I just hope Clarence Thomas doesn’t drop.

Ball’s in Their Court

US Supreme Court justice Amy Coney Barrett just ordered the defendants in National Association for Gun Rights v. Naperville to explain why the court should not enjoin Illinois’s “assault weapon” ban law. [Watch]

Again, this is more procedural than anything. That doesn’t mean justice isn’t being delayed and denied for some. I know as an SNBIer, I’m the last person to talk about nuance, but a High Court that can bypass appeals protocols here can bypass it elsewhere, and you’d better believe one with a different composition would exploit the hell out of that.

I’m surprised so many of Mark W. Smith’s followers in the video’s comments don’t seem to grok his points.

But yeah, I suspect if she had her druthers she wouldn’t be a purist. Neither would Roberts, or Kavanaugh, or… and don’t get me started on Scalia.

This is the hand we’re dealt. It’s up to us to play it smart.
