He is doing so to prove that if he can get approval for the Javelin launcher, which is a more destructive portable arm (firearm, to be exact) than semi and full autos, then he should get approval for full autos.

Ahh. That is awesome. The gov argument is that he has no “right” to possess it under the 2A, not that he cannot legally possess it. So if the gov decides to ban it, there is no issue. That is what the gov argues.
