On Whose Authority?

[T]he issue that was being examined is to what extent a regulatory agency, a part of the administrative branch of government, would adopt, interpret or establishment by rules or regulations policies which Congress did not adopt and which Congress did not clearly and specifically delegate to the agency to adopt. That question is at the core of the legal issues involving the ATF’s regulatory bans… [More]

Call me a naive dreamer, but I still hold on to a fleeting fantasy that someday, ATF will be forced to surrender my property back to me. That’s why I got a stock I had no use for except to claim and defend my right to own it.

As I’ve surmised before, we’re going to need two things to happen: First, the Republicans are going to have to not blow the “red wave” and reclaim House Oversight and Senate Judiciary, and second, unlike with “Gunwalker,” they’re going to have to strap ’em on and get serious about investigating and prosecuting all the way to the top.

Those Who Remember the Past…

WarOnGuns Correspondent Jess asks via email:

David, Is that something that ATF actually ordered? If I was Leatherman, I’d have sent ’em a sample alright, but with a small change. At either end of the line “Always Think Forfeiture”, I would have also engraved a hammer and sickle!

They tried but the order was canceled after Congressman Bill Sali, (R-Idaho), raised objections.

But big John Kerry supporter TimLeatherman would have loved to fill the order.

“I told her we prefer ‘gun enthusiast,’” Nagel said. “She said she prefers ‘gun nuts,’ and she works for the ATF?”

Scott found nothing in the shop’s books other than a few minor clerical errors. There were no missing firearms or other significant problems.

“She said she was going to put us in for revocation, and that it may change as it goes up the chain, but that was her recommendation,” Nagel said. [More]

She sounds like a hook-baiter.

Tyranny enforcers haven’t learned a thing since King George “sent hither swarms of officers to harass our people.” I wonder if Republicans don’t blow it in November if House Oversight will subpoena her.

Dance, Puppets, Dance!

The U.S. gun industry has effectively “captured” the law enforcement agency charged with regulating it, according to a new report from the Giffords Law Center that recommends a number of changes to the Bureau of Alcohol, Tobacco, Firearms and Explosives. [More]

Now that I know NSSF is holding them hostage maybe they can order them to cough up that information on Hunter Biden they’ve been holding on to…

It Depends Upon What the Meaning of the Word ‘Minor’ Is

Lawyer Jim Trusty, former chief of the DOJ’s Organized Crime Section, said reports that the investigation is coming to an end suggests that Hunter will be hit with minor tax charges and for making false statements when purchasing a handgun in 2018.  [More]

Purchasing two handguns, actually, if anyone in authority is interested in, you know, investigating. And for each instance:

The Brady Handgun Violence Prevention Act of 1993, ushered into law by then-Sen. Joe Biden, at the time chairman of the Senate Judiciary Committee, made Form 4473 a key part of background checks for gun purchases mandated by the law.

Lying on the form is a felony punishable by up to 10 years in prison. For being a user of unlawful drugs in possession of a firearm, the punishment is up to five years.

I’ll have to ask Stephen Stamboulieh if Hunter pleads out what that will do to my ATF complaint.

Cause and Effect

Steven Dettelbach, the newly sworn-in director of the Bureau of Alcohol, Tobacco, Firearms and Explosives, said there is no overarching answer to solving the nation’s gun violence, even as guns have become the leading cause of death for children in the U.S. [More]

All by their own selves?

But what about those numbers?

This is how it works: Step one, acquire statistics on firearm-related deaths among children ages 1-14. Step two, combine that relatively low number with the far greater number of firearm-related deaths involving juveniles and young adults ages 15-19, or even ages 15-24. Step three, present the resulting data as the shocking number of “children” (ages 1-19 or 1-24) who are subjected to “gun violence” each day/week/month/year. Step four, use the disingenuous statistic to advocate for pre-determined gun control policies.

Gee, it’s almost like the media are the enemy or something…

Never talk to the police. All that friendly and reasonable posturing is just that.

At most, he could have said something like “Give me your card and I will have my lawyer call you.”

Although I do admit, if I had ATF and Delaware State Police together in one handy, recordable location, I’d have been willing to extend the conversation to questions about Hunter Biden’s gun.
